Petition to Support Chicago's Free Market and Consumers Choice

Whereas, the Chicago City Council enacted a ban on the sale of Foie Gras on April 26th, 2006; and

Whereas, the City Council imposed said ordinance outside the scope of their governing authority to protect the health, safety, and welfare of its citizens; and

Whereas, this ordinance may violate the Interstate Commerce Clause of the Constitution; and

Whereas, this ordinance may also violate provisions of the Constitution such as, but not limited to, Preemption, Substantive Due Process, Freedom of Expression, and Eminent Domain; and

Whereas, the Honorable Mayor Richard M. Daley has cast doubt on whether this ordinance is germane to the City Council; and

Whereas, this ordinance interferes with free market trade and violates both consumer choice and the freedom of expression expressly guaranteed to those engaged in the culinary arts; and now, therefore,

Be it here resolved, that all those signing this petition oppose the Chicago City Ordinance banning Foie Gras, and further ask that the Mayor's Office use all of its powers, including those vested in the Mayor to uphold the Constitution of the United States, to repeal this unjust and overly intrusive legislation.
